California Pushes to Fill Gap Being Left by CFPB

The California legislature is pushing a bill that would enhance the powers of the state’s top financial to oversee businesses traditionally governed by the federal Consumer Financial Protection Bureau. As the federal government scales back its consumer protection efforts, the bill aims to fill the void left by the CFPB’s reduced oversight, especially in light of the changes initiated under the Trump administration.

The bill, SB 825, aims to enhance the authority of the California Department of Financial Protection and Innovation (DFPI), enabling it to take enforcement actions against businesses that engage in unfair, deceptive, or abusive acts or practices. This measure, introduced by Senator Monique Limón, has passed through the Senate Banking and Financial Institutions Committee on a party-line vote and now moves to the Senate Judiciary Committee.

SB 825 is seen as a direct response to the significant retreat of the CFPB during the Trump administration. A report found that CFPB enforcement actions dropped by 75% from 2017 to 2020, despite a rise in consumer complaints. The rollback of CFPB activities, particularly in enforcing key regulations such as payday lender oversight and military lending protections, left many consumers vulnerable to predatory financial practices.

California’s proposed legislation seeks to ensure that the DFPI can step in where the federal government has fallen short. The bill would grant DFPI the authority to enforce the prohibition of unfair, deceptive, or abusive acts within the financial sector, regardless of the license under which a business operates. While the state cannot fully replace the federal CFPB, SB 825 represents an attempt to strengthen consumer protections and provide Californians with more robust legal recourse when they encounter harmful financial practices.

Supporters of SB 825, including consumer advocacy groups like the Consumer Federation of California and the National Consumer Law Center, argue that the state needs to take a more active role in consumer financial protection due to the federal government’s reduced focus in this area. They emphasize that Californians should not be left unprotected as the CFPB’s enforcement capacity continues to shrink. The bill aims to enhance DFPI’s independence and efficiency in handling complaints, ensuring that the state has the tools necessary to tackle unfair practices in the financial sector.

However, not everyone is on board with the proposed expansion of DFPI’s authority. The California Mortgage Bankers Association has raised concerns that the bill could lead to redundant investigations for businesses already under the regulation of other state agencies. The opposition argues that the DFPI’s current authority, combined with cooperation from the Attorney General’s office, is sufficient to manage cases of unfair or deceptive practices.

The bill’s progression reflects California’s continued push to be a leader in consumer financial protection, especially at a time when federal efforts appear to be waning. As businesses in the financial sector continue to navigate an evolving regulatory landscape, California’s move to expand the DFPI’s enforcement powers may signal a trend where states increasingly take on roles traditionally held by federal agencies.
