Court Grants Motion to Dismiss FDCPA Case for Second Time, Denies Sanctions

A District Court judge in Oregon has granted — for the second time — a defendant’s motion to dismiss a Fair Debt Collection Practices Act lawsuit, while also denying the defendant’s motion for sanctions. The decision, made by Judge Michael H. Simon of the District Court for the District of Oregon, comes after the plaintiff, representing herself, filed an amended complaint alleging the defendant falsely marked her account as disputed when furnishing information to the credit reporting agencies.

The background: The lawsuit was initially filed last October, with the plaintiff claiming that she had not disputed the debt, and the notation was a violation of Sections 1692e(8) and 1692e(2)(A) of the FDCPA.

  • The defendant filed a motion to dismiss, showing that the plaintiff had disputed the debt by explicitly refusing to pay it in writing. Additionally, the judge ruled that the plaintiff did not establish standing to sue under the FDCPA.
  • The plaintiff was given the opportunity to amend the complaint, but the subsequent complaint did not cure the identified deficiencies, leading to the ultimate dismissal of the case.

The ruling: Judge Simon ruled that the plaintiff’s amended complaint continued to lack sufficient factual allegations to state a claim for relief. He concluded that the plaintiff had, in fact, disputed the debt when she stated she refused to pay it. Thus, the defendant’s reporting that the debt was disputed was not a violation of the FDCPA. Furthermore, Judge Simon ruled that the plaintiff failed to demonstrate standing — she claimed to have suffered emotional distress, but did not provide any specific injuries and her claims that she was “very upset” were too vague for the judge to admit.

  • In a separate motion, the defendant sought sanctions, arguing that the amended complaint was frivolous and filed without a competent inquiry. However, Judge Simon denied the sanctions request, noting that although the plaintiff’s filing was deficient, it was not filed in bad faith.
  • Ultimately, the court dismissed the case with prejudice, meaning the plaintiff cannot refile the claims.
