GAO Investigating CFPB’s Recent Actions Amid Staff Reductions

The Government Accountability Office (GAO) has confirmed it will investigate recent actions taken by the Consumer Financial Protection Bureau under the direction of Acting Director Russell Vought. The inquiry comes after Democratic senators, including Elizabeth Warren [D-Mass.] and Andy Kim [D-N.J.], requested the GAO examine the impact of significant workforce reductions and other moves that could undermine the CFPB’s ability to enforce consumer protection laws.

Why it matters: In recent months, the CFPB, under Vought’s leadership, initiated a reduction in force that would cut approximately 90% of its workforce, leaving only 200 of its 1,700 employees. This move, which was set to take effect in mid-April, raised alarms about the agency’s ability to carry out its congressionally mandated duties, including protecting consumers from fraud and regulating large financial institutions.

The senators expressed concerns over the legality of these actions, particularly as they would leave critical divisions of the agency severely understaffed or completely dismantled. These departments include the Office of Service Member Affairs, which helps military personnel and their families, and the Office of Financial Protection for Older Americans, which serves seniors at high risk for financial abuse.

Key developments:

  • The GAO has agreed to look into the impact of the workforce reductions on the CFPB’s capacity to meet its statutory obligations, such as addressing consumer complaints and supervising financial institutions.
  • The inquiry follows a letter sent by 40 senators to Vought, demanding a detailed explanation of how the CFPB plans to fulfill over 80 statutory obligations with such a diminished staff.
  • On April 17, the CFPB attempted to lay off 1,483 employees. This decision was halted by a ruling from the U.S. Court of Appeals for the District of Columbia Circuit, which restored a lower court injunction blocking the layoffs until further proceedings.

What’s next: The GAO’s investigation is set to begin soon, with plans to assess whether the workforce reductions violate the CFPB’s legal obligations. The results could influence ongoing litigation and legislative responses.

This investigation highlights the ongoing tensions over the future of the CFPB, with Democrats defending the agency’s role in consumer protection, while critics argue that its existence is a form of government overreach. As the situation develops, both legal and legislative actions will play a crucial role in shaping the agency’s future.
