Student Loan Collections Resume Today

After a five-year hiatus, the Department of Education will resume involuntary collections on federal student loans today, impacting millions of borrowers already in default. As of May 5, the department will begin garnishing wages, tax refunds, and Social Security payments for borrowers who have defaulted on their loans, a significant shift after a pandemic-era pause on collections.

Key Facts:

  • Impact on Borrowers: More than 5 million borrowers are currently in default, with the total number expected to reach 10 million within months. The Department of Education is set to initiate collections on loans that have been in default for more than 270 days.
  • Collections Start: Starting May 5, wage garnishments will commence following a required 30-day notice. Borrowers who owe federal student loans could see up to 15% of their paychecks withheld if they don’t make arrangements.
  • Delinquency Rates: Nearly 4 million borrowers are in late-stage delinquency (more than 90 days behind), with the remainder still in repayment, though the majority have missed multiple payments.

What Borrowers Can Do: For borrowers facing financial difficulty, experts recommend reaching out to the Department of Education or their loan servicer to explore repayment options before the garnishments begin. Borrowers who have missed payments are encouraged to:

  1. Enroll in Income-Driven Repayment Plans: These plans adjust monthly payments based on income and family size, providing relief to those struggling with large debt balances.
  2. Consider Loan Rehabilitation: For borrowers in default, this program offers a chance to get back on track without facing severe financial penalties.
  3. Look into Loan Consolidation: This option can help borrowers manage their debt more efficiently, especially for those struggling with multiple loans.

Experts are advising borrowers to act early and not wait until the garnishment process begins, as the consequences of default are far-reaching. As Betsy Mayotte, president of the Institute of Student Loan Advisors, points out, “If you can’t afford your loan now, you’re really not going to be able to afford it if you let it default.”

Impact on Consumer Spending: According to a Bloomberg Economics report, rising student loan defaults could reduce consumer spending by up to $63 billion annually. With fewer borrowers making payments, the ripple effect will likely extend beyond student loan servicers, impacting industries that rely on consumer spending.

Navigating the Future of Student Loan Collections:

The restart of collections also signals a return to previous collection practices, including potential court actions for those failing to make arrangements. Advocacy groups, such as the Student Borrower Protection Center, have expressed concerns about the impact this will have on vulnerable borrowers, who now face not just financial stress but also the possibility of legal action and garnishments.
