Pennsylvania Court Affirms Remote Testimony in Debt Collection Dispute

A Pennsylvania Appeals Court has affirmed a lower court’s ruling in favor of a creditor that sued a consumer over an unpaid credit card bill, where the trial court allowed a witness to testify remotely.

The background: The case stems from a debt collection dispute between a major creditor and a consumer who failed to pay off her credit card balance. In 2018, the consumer, who had applied for and used a credit card issued by the creditor, accumulated a debt of $8,347.94. After not making payments, the creditor filed a complaint and attempted to recover the debt through arbitration. The arbitration panel ruled in favor of the consumer, prompting the creditor to take the matter to the trial court.

During pre-trial proceedings, the creditor requested that its custodian of records, a key witness, testify remotely via Zoom from Arizona. The consumer objected to this, arguing that remote testimony would undermine her ability to cross-examine the witness and cast doubt on the credibility of the testimony. Despite the objection, the trial court permitted the witness to testify remotely.

The ruling: The Pennsylvania Appeals Court upheld the trial court’s decision, affirming that the remote testimony did not violate the consumer’s rights. In its ruling, the court emphasized the discretion of trial courts in regulating trial conduct, including the mode of witness testimony. The court found that the consumer had adequate opportunity to challenge the testimony, and the court was able to assess the credibility of the remote witness.

The consumer had raised concerns about the validity of the remote testimony under Pennsylvania law, but the court determined that it was within its discretion to allow the testimony. Furthermore, the court found no error in admitting the documents related to the debt, which had been provided to the consumer months prior to the trial.

The appeals court dismissed the consumer’s arguments, pointing out that the decision to allow remote testimony was not an abuse of discretion and that the trial court had reasonably ensured a fair trial process.

The ruling confirms the growing acceptance of remote testimony in civil matters, even as concerns about cross-examination and witness credibility remain key points of contention in some cases.
