Judge Finds Factual Disputes in Air Ambulance Billing Collection Case

A District Court judge in Texas has denied a defendant’s motion for summary judgment in a Fair Credit Reporting Act and Fair Debt Collection Practices Act case over the portion of a medical debt that was not paid by the plaintiff’s health insurance when his daughter needed to be transported to a hospital via an air ambulance, but did dismiss one of the claims on the grounds the plaintiff lacks standing because he opened a Model Validation Notice that was inadvertently sent to his ex-wife at his address.

The background: The dispute began after the plaintiff’s daughter was airlifted to a hospital following a car accident. The air ambulance provider billed $56,684 to the family’s health insurer, which paid about $43,000 and denied the remaining $13,650 as out-of-network charges. Despite a note from the insurer that the patient was not liable for the unpaid portion, the provider sent the remaining balance to collections.

  • The defendant, a collection agency, mailed the plaintiff an initial notice — and accidentally mailed a duplicate to his ex-wife, though it was delivered to his address.
  • The plaintiff opened the letter and later informed his ex-wife of its contents.
  • He disputed the debt with the credit bureaus, arguing that the debt had been fully paid under his insurance and that the collection agency had furnished inaccurate information and used misleading representations when attempting to collect.

The ruling: Judge Brantley Starr of the District Court for the Northern District of Texas found that there were “genuine disputes of material fact” over whether the collection agency properly investigated the debt before reporting it and whether its collection activity violated the FDCPA. The judge noted that a jury could find the agency’s investigation inadequate because it may have failed to review critical documents like the Explanation of Benefits that supported the plaintiff’s position.

  • However, Judge Starr did dismiss the plaintiff’s claim under section 1692c(b) of the FDCPA, which prohibits communicating debt information to third parties, ruling that he lacked standing. Although the defendant technically violated the statute by mailing a duplicate notice to the plaintiff’s ex-wife, the judge found no concrete injury since the plaintiff himself opened the letter and chose to share it. As the opinion noted, “Ray himself opened a letter addressed to his ex-wife and then chose to share its contents with her… any alleged emotional distress or embarrassment… cannot constitute a concrete, particularized injury.”
  • In a lighter moment, the judge also rejected the plaintiff’s unusual “motion to deny” the defendant’s right to seek summary judgment, calling it “a misguided attempt to relitigate the mere right of the opposing party to seek summary judgment” and noting that the federal rules “do not permit denying [the defendant’s] right to file a motion for summary judgment.”
  • With summary judgment denied, the remaining FCRA and FDCPA claims will move forward toward trial.
