Indiana Appeals Court Affirms HOA Win in FDCPA Dispute

An Indiana Appeals Court has affirmed a ruling for a defendant, a homeowners association, that was accused of violating the Fair Debt Collection Practices Act, ruling the plaintiff, who represented herself, for the second time did not present “any evidence” regarding whether the HOA “violated the FDCPA.”

The background: The case began after the HOA filed a complaint alleging the plaintiff had failed to pay regular and special assessments tied to her property. According to the record, the unpaid balance at the time of filing was just over one thousand dollars, and the defendant sought assessments, interest, fees, and costs.

  • The plaintiff responded by arguing that the debt amounts were inaccurate, that the defendant’s affidavit was defective, that service of process had been invalid, and that multiple provisions of the FDCPA had been violated.
  • The plaintiff also asserted that the HOA had not provided required validation notices and had used misleading terminology when attempting to collect the debt.
  • A trial court judge granted summary judgment for the HOA, ordering the plaintiff to pay more than $3,300 in assessments and fees.

The ruling: The Appeals Court upheld the trial court’s decision granting summary judgment to the defendant. A key finding centered on the plaintiff’s burden to designate evidence when alleging FDCPA violations.

  • The panel noted that while the plaintiff claimed misrepresentation and improper collection behavior, she did not designate any evidence supporting those claims.
  • The court wrote that she had offered only “bald statements” and had not created any genuine issue of material fact. As a result, her allegations of statutory violations could not survive summary judgment.
  • The court also rejected the plaintiff’s due process and personal jurisdiction arguments. Regarding service of process, the decision points to documentation showing that the sheriff both left a copy of the summons at the plaintiff’s residence and mailed a copy to the same address. On the due process issue, the appellate panel observed that the plaintiff was given a hearing and an opportunity to present evidence but did not do so.
  • In reviewing the affidavit issue, the court noted that the plaintiff had not identified which portions of the affidavit were hearsay and therefore had not met her burden to demonstrate error.
