Seventh Circuit Revives FDCPA Class Action Over Alleged “Artificial” Acceleration Threat

The Court of Appeals for the Seventh Circuit has reversed a lower court’s dismissal of a Fair Debt Collection Practices Act class-action lawsuit, ruling that the threat of accelerating the debt which induced the plaintiff to make a payment is sufficient for the plaintiff to have standing to sue. The panel also questioned whether the defendant, a mortgage servicer, could rely on the mortgage’s notice-and-cure provision without proving it was an assignee of the lender under Illinois law.

The background: The plaintiff fell behind on mortgage payments in 2023. The defendant, acting as the loan servicer, sent a letter when the plaintiff was 47 days overdue, stating that the borrower had 35 days to cure the delinquency or face acceleration, foreclosure, or a property sale.

  • The plaintiff made a payment in response, then filed a class-action lawsuit arguing that the timeline in the letter was misleading because the servicer could not legally accelerate or foreclose until the loan was at least 120 days delinquent.
  • The lawsuit asserted violations of the FDCPA, the Illinois Consumer Fraud and Deceptive Business Practices Act, and negligent misrepresentation.
  • A district court judge dismissed the complaint, holding that the defendant qualified as an assignee of the lender and was therefore entitled to enforce the mortgage’s notice-and-cure provision. Because the plaintiff did not provide the required pre-suit notice, the court concluded the claims were barred.

The ruling: On appeal, the Seventh Circuit raised standing concerns and ordered supplemental briefing. The plaintiff then clarified that paying the mortgage earlier than required caused specific monetary harm, including overdraft fees and borrowing funds to cover health insurance premiums.

  • The Court found these allegations sufficient, explaining that the plaintiff “acted to her detriment” by making a payment induced by the allegedly misleading deadline. As the opinion put it, the new allegations “say enough about how she suffered monetary harm” to establish Article III standing.
  • The panel also rejected the district court’s conclusion that the servicer was automatically an assignee, noting that Illinois law distinguishes delegation of duties from assignment of rights. The servicing agreement was not in the record, the Court said, and the existing documents did not establish that the lender had transferred any ownership interest to the servicer. “We cannot resolve on the pleadings that [the servicer], as a mortgage loan servicer, is an assignee as a matter of Illinois law,” the Court wrote.
