Judge Says Federal Courts Cannot Revisit Arbitration Awards Through FDCPA and FCRA Claims

A Magistrate Court judge in New Mexico has recommended dismissing a lawsuit filed by a consumer against a financial institution that sought to vacate an arbitration award of nearly $50,000 in the institution’s favor over claims the institution violated the Fair Debt Collection Practices Act and the Fair Credit Reporting Act. The recommendation, issued in a Proposed Findings and Recommended Disposition, centers not on the merits of the consumer protection claims themselves, but on whether the federal court had the authority to hear the case at all.

The background: The plaintiff initially filed a petition asking the court to vacate or modify an arbitration award that totaled approximately $43,956 and included attorney fees and costs awarded to the defendant. In the arbitration, the plaintiff had asserted counterclaims under several federal consumer protection statutes, including the FDCPA and FCRA, and argued that the arbitrator exceeded his authority and manifestly disregarded the law.

  • After reviewing the initial filing, the court issued multiple orders to show cause, giving the plaintiff opportunities to explain why federal jurisdiction existed or to amend the petition to cure jurisdictional defects. The plaintiff amended the petition, but ultimately did not respond to a second order to show cause.

The ruling: Judge Jennifer M. Rozzoni of the District Court for the District of New Mexico found that neither federal question nor diversity jurisdiction applied. Relying heavily on the Supreme Court’s decision in Badgerow v. Walters, Judge Rozzoni explained that petitions to vacate or modify arbitration awards do not automatically confer federal jurisdiction. Courts may not “look through” those petitions to the underlying arbitration claims, even if those claims arise under federal law.

  • As the judge put it, “The [Federal Arbitration Act] does not in and of itself support federal subject-matter jurisdiction,” and the plaintiff’s reliance on federal statutes asserted during arbitration was legally insufficient.
  • The court also rejected diversity jurisdiction, finding it was “legally certain” the amount in controversy did not exceed $75,000. When seeking to vacate an arbitration award, the relevant amount is the face value of the award itself, not the speculative value of reinstated claims in a future proceeding.
  • Because the court lacked jurisdiction, the magistrate judge also recommended denying the defendant’s pending motions for attorneys’ fees and costs and dismissing the case in its entirety.
