Paper: Big Tech Is Redefining Consumer Payments, but the Law Isn’t Keeping Up

Big Tech has fundamentally transformed how consumers pay, move, and access money, from peer-to-peer apps and real-time bank transfers to mobile check deposits, crypto payments, and AI-powered payment tools. These innovations have delivered speed, convenience, and flexibility for consumers and merchants alike. But according to a recent legal analysis, many of these payment systems now operate in areas where the law offers little clarity or protection, creating risk not just for consumers, but also for banks, fintechs, healthcare providers, and collection operations that rely on them.

Convenience vs. Consumer Protection

The Electronic Fund Transfer Act (EFTA) and Regulation E were designed decades ago for debit cards and ATMs. While they still apply to some modern tools, they leave significant gaps:

  • Peer-to-peer payments: If funds are stored in an account, limited EFTA protections may apply. But many fraud cases involve consumers being tricked into authorizing payments, which often falls outside the law’s protections.
  • Wire transfers and FedNow: Consumer wire transfers are typically governed by UCC Article 4A, a framework originally designed for wholesale business transactions. It offers minimal consumer protections, even as fraud in consumer wire transfers has surged.
  • Remote deposit capture: Mobile check deposits create dual instruments: a paper check and an electronic image, which increases the risk of double deposits and fraud, while existing rules have not been fully updated to address these risks.
  • Crypto payments: Whether crypto qualifies as “funds” under federal payment laws remains unsettled, leaving consumers and companies in a legal gray area when disputes arise.

Why This Matters for Creditors and Servicers

For organizations that accept payments from consumers, these gaps matter operationally and legally. Disputes over unauthorized transfers, fraud claims, delayed availability of funds, and liability allocation are becoming more common, while regulatory guidance remains fragmented and inconsistent.

The analysis highlights a broader pattern: payment technology is advancing faster than the laws meant to govern it. In the absence of updated federal standards, companies are often left relying on contracts, disclosures, and internal controls to manage risk. These are tools that may not always hold up when disputes arise.

Looking Ahead

As AI, real-time payments, and alternative payment methods continue to expand, payment acceptance strategies must account not only for efficiency and consumer preference, but also for legal exposure. Until the regulatory framework catches up, understanding where technology outpaces the law may be just as important as adopting the technology itself.
