NYC Finalizes New Debt Collection Rule

New York City today has formally adopted a sweeping set of amendments to its debt collection rules, locking in expanded compliance obligations for collection agencies, debt buyers, and original creditors once they engage in “debt collection procedures,” with an effective date of September 1, 2026. The final rule clarifies long-debated issues around communication limits, validation and verification, time-barred debt disclosures, medical debt verification, and recordkeeping, and confirms that original creditors are not exempt once accounts enter collection. For companies in the credit and collection industry, the changes reinforce that New York City remains one of the most prescriptive local regimes for consumer debt collection.

What changed and why it matters: The New York City Department of Consumer and Worker Protection said the amendments are meant to clarify and expand consumer protections in light of federal and state changes, industry feedback, and rising complaints about aggressive communication practices.

Key takeaways for operations and compliance teams include:

  • Original creditors are covered. The rules continue to apply to original creditors once they initiate debt collection procedures. This is a notable divergence from federal law, which generally excludes original creditors from FDCPA coverage.
  • Communication frequency clarified. Collectors may communicate up to three times in seven days per account, not per consumer, once an account is in collection. Attempted communications and electronic messages remain within scope, with certain carveouts such as mailed communications.
  • Electronic communications require revocable consent. The final rule streamlines consent for email and text outreach, and clarifies that a consumer’s “stop” request applies to that specific channel.
  • Validation and verification rules are reinforced. Collectors must provide detailed validation notices and accept disputes at any time during collection activity. Failure to timely verify a disputed debt can require cessation of collection efforts by that collector.
  • Medical debt gets special treatment. When a consumer disputes medical debt, collectors may need to verify related accounts tied to the same episode of care, with some limits and clarifications added to reduce burden.
  • Time-barred debt disclosures updated. The required notice language was modified to clarify consumer rights and warn that making a payment may restart the statute of limitations for certain debts.
  • Robust recordkeeping remains mandatory. The final rule preserves extensive documentation requirements around communications, disputes, cease requests, credit reporting notices, and policies.
