Appeals Court Affirms Summary Judgment in FCRA Case Over Medical Debt Reporting

The Court of Appeals for the Ninth Circuit has affirmed a ruling in favor of a defendant in a Fair Credit Reporting Act lawsuit over the accuracy of the information being furnished and the reasonableness of a dispute investigation of a medical debt incurred by the plaintiff’s husband.

The background: The case centered on a medical debt incurred by the plaintiff’s husband for dental treatment. The debt was later placed in collections and appeared on the plaintiff’s consumer report as a joint obligation. The plaintiff claimed that the reporting was incorrect because she never personally entered into a contract with the medical provider that performed the treatment.

  • Based on this argument, the plaintiff alleged that the defendant violated two provisions of the FCRA. First, she argued the defendant failed to follow reasonable procedures to assure maximum possible accuracy of information in consumer reports. Second, she argued the defendant failed to conduct a reasonable reinvestigation after she disputed the debt.
  • At the heart of both claims was the plaintiff’s contention that the report incorrectly indicated she had joint contractual liability for the account. According to the plaintiff, labeling the account as a joint obligation implied she personally entered into a contract with the medical provider and breached that contract.

The ruling: The Ninth Circuit concluded that the plaintiff’s claims failed because the reporting was neither patently false nor materially misleading. The court emphasized that a consumer must demonstrate an actual inaccuracy in the report in order to proceed with an FCRA claim.

  • In analyzing the issue, the court focused heavily on the implications of Arizona’s community property laws. Under those laws, spouses may share liability for certain debts incurred during the marriage, including necessary medical expenses.
  • The court noted that even though the plaintiff was not a party to the original agreement with the medical provider, she nevertheless shared legal responsibility for the debt through the marital community. Because of that legal framework, the court determined that describing the account as a joint obligation was not inaccurate.
  • The panel explained that the plaintiff herself acknowledged that she had community responsibility for the debt arising from her marriage. The court observed that “contractual responsibility for [a] joint account could reasonably be understood to cover any situation in which a consumer enters into a contract that makes her jointly liable for a debt.”
  • The court also rejected the argument that the report was misleading. It found that the plaintiff provided no evidence showing that creditors would interpret the account designation in the way she claimed. As the court put it, the examples cited by the plaintiff about joint accounts in credit card contexts were insufficient to demonstrate that lenders would misunderstand the nature of the liability.
