Former CFPB Policy Fellow Argues Consumer Protection Is a Barometer of Gov’t Priorities

A former policy fellow at the Consumer Financial Protection Bureau is making a broad argument about the role of consumer protection laws in the United States, suggesting that how a government treats these laws serves as a clear signal of its priorities and its commitment to protecting ordinary citizens.

In a newly published working paper, the author argues that consumer financial protection laws affect nearly every American and that the strength of these protections can act as a benchmark for how policymakers value individuals relative to businesses and markets. Because almost everyone interacts with financial products, from loans and credit cards to bank accounts and debt collectors, the regulatory framework surrounding consumer finance has one of the widest impacts of any area of law.

The paper contends that the federal government’s approach to enforcing and maintaining these protections reveals broader policy priorities and may even reflect the health of democratic governance.

The article examines consumer protection law through a framework that evaluates three factors:

  • The number of individuals protected
  • The breadth of entities regulated
  • The available avenues for enforcement

Using that framework, the author concludes that consumer protection law is one of the most impactful legal regimes in the United States because it covers a massive share of the population and regulates a wide array of industries.

Consumer financial protection laws, in particular, govern everyday financial activity such as borrowing money, repaying loans, using payment cards, and interacting with debt collectors. These activities touch nearly every American household, making the scope of consumer financial regulation unusually broad compared with other areas of law.

The paper also highlights the role of the Dodd-Frank Act of 2010, which created the CFPB following the financial crisis. The law consolidated oversight of federal consumer financial statutes and expanded enforcement authority, supervision, and rulemaking related to financial products and services.

The paper ultimately frames consumer protection laws as more than a regulatory tool. Instead, it argues they function as a signal of governmental priorities.

Because consumer financial protections apply to individuals regardless of wealth or status, weakening those protections can indicate a shift toward prioritizing corporate interests over consumer welfare.

The author also suggests that attacks on consumer protection frameworks can serve as an early indicator of broader policy shifts. When lawmakers roll back or undermine these protections, they are effectively choosing other interests over the consumers who make up their constituencies. In other words, the strength of consumer protection laws may say as much about the direction of public policy as the rules themselves.
