Utah Court Says Lease-Related Charges Can Qualify as FDCPA Debt

A District Court judge in Utah has denied a motion to dismiss a Fair Debt Collection Practices Act suit, disagreeing with the defendant’s argument that the debt was not subject to the statute.

The background: The case centers on a dispute between a residential tenant and her landlord over alleged property damage following the end of a lease. The plaintiff had paid a $2,100 security deposit and, upon vacating the property, agreed that $849 could be deducted for repairs beyond normal wear and tear.

  • Despite that agreement, the landlord, through a third-party debt collector, sought to collect $4,413 for additional repairs. The plaintiff alleges that the collection efforts included a letter and multiple emails that failed to include key FDCPA disclosures, such as notifying her that the communication was an attempt to collect a debt and outlining her dispute rights.
  • The defendants moved to dismiss the FDCPA claims, arguing that the obligation did not arise from a “consumer transaction” but instead from alleged negligent damage to the property. In their view, that distinction placed the obligation outside the scope of the FDCPA.

The ruling: Judge David Barlow of the District Court for the District of Utah rejected that argument, focusing heavily on the existence of a contractual relationship and the origin of the obligation in the lease agreement.

  • In distinguishing prior case law relied on by the defendants, the judge emphasized that those cases involved obligations arising purely from torts with no underlying consensual transaction. Here, by contrast, the obligation “arises in connection with” a residential lease, which is a consumer transaction.
  • Judge Barlow pointed to Tenth Circuit precedent from 1998 suggesting a broader interpretation of “debt,” noting that obligations tied to agreements for personal or household purposes can fall within the FDCPA even if they are not traditional payment obligations like rent.
  • Importantly, the judge also pushed back on the defendant’s attempt to recharacterize the nature of the claim, noting that the plaintiff controls how the claim is framed. Citing language from the Supreme Court, the plaintiff is “the master of the complaint,” and the allegations here plausibly tied the obligation to the lease rather than to a standalone tort theory, Judge Barlow ruled.
  • At this stage of the case, that was enough. Applying the motion to dismiss standard, the court found that the plaintiff had “nudged” her claim into the realm of plausibility, allowing the FDCPA claims to proceed.
  • Because the federal claims remain intact, the court also retained jurisdiction over the related state law claims.
