Workers’ Comp Angle Derails MTD in FDCPA Suit

A District Court judge in New York has denied a defendant’s motion to dismiss claims it violated the Fair Debt Collection Practices Act, ruling that the defendant “grossly mischaracterized” the plaintiff’s alleged injury — paying a medical debt that was incurred as a result of being treated after being injured at work. The decision centers on a relatively small dollar amount but highlights a much larger issue for collectors: the risks associated with pursuing medical debts that may be subject to workers’ compensation protections.

The background: The plaintiff was injured at work in late 2023 and received medical treatment at a hospital shortly thereafter. She later asserted her rights under New York’s workers’ compensation system, and the Workers’ Compensation Board ultimately determined that her injury was work-related.

  • Despite that determination, the defendant sent a letter in January 2025 seeking payment of a $74 balance tied to that treatment. The plaintiff responded in writing, notifying the defendant that the debt should be covered by workers’ compensation and that she was not personally responsible.
  • Two days later, the defendant sent a second notice indicating the balance remained due and past due. Faced with the possibility of negative consequences, the plaintiff paid the $74.
  • She later filed suit, alleging that the collection efforts were deceptive and misleading under multiple provisions of the FDCPA.

The ruling: The defendant moved to dismiss, arguing that the plaintiff lacked standing because any injury was self-inflicted and based on an irrational fear of future harm. Judge Margaret M. Garnett of the District Court for the Southern District of New York rejected that argument outright.

  • “This is not the case of a plaintiff who suffered only an intangible injury,” Judge Garnett wrote. “This is the case of a plaintiff who allegedly paid a debt because the defendant falsely told her she was liable… That is, Plaintiff paid money she did not owe.”
  • That distinction proved critical. The judge emphasized that financial loss is a “classic pocketbook injury” sufficient to establish standing. It also found causation to be straightforward, noting that the plaintiff’s loss occurred because she did exactly what the defendant demanded.
  • On the merits, the court found the plaintiff plausibly alleged violations of the FDCPA, particularly under provisions prohibiting false or misleading representations about the legal status of a debt. At this stage, the allegations that the defendant attempted to collect a debt it knew or should have known was not owed were enough to proceed.
