Judge Tosses FCRA, ADA, ECOA Claims in Repossession Lawsuit Against Credit Union

A District Court judge in Nevada has dismissed a consumer’s Fair Credit Reporting Act claim tied to the repossession of her vehicle, finding that the complaint failed to establish one of the most fundamental requirements for triggering a furnisher’s duties under the statute. The ruling underscores a recurring issue in FCRA litigation: the difference between complaining to a regulator and properly disputing information through a credit reporting agency.

The background: The plaintiff entered into a loan agreement to finance a vehicle and later defaulted on that loan. Following the default, the vehicle was repossessed by a recovery company acting at the direction of the creditor.

  • The plaintiff alleged a wide range of claims arising from the repossession, including that the vehicle was improperly handled, that she experienced medical distress at the time of repossession, and that the creditor engaged in misconduct across several legal theories.
  • Among those claims was an allegation that the creditor violated the FCRA by failing to properly investigate disputed information. The plaintiff asserted that the creditor “failed to conduct a reasonable investigation” after receiving notice of a dispute.
  • However, the complaint also indicated that the plaintiff had primarily filed complaints with the Consumer Financial Protection Bureau rather than submitting a dispute through a credit reporting agency.

The ruling: Judge Miranda M. Du of the District Court for the District of Nevada granted the defendant’s motion to dismiss the FCRA claim, focusing squarely on the statutory trigger required to impose duties on furnishers of information. The judge emphasized that those duties arise only after a furnisher receives notice of a dispute from a credit reporting agency, not directly from a consumer or through a regulatory complaint.

  • Judge Du found that the plaintiff’s allegations were insufficient because they were largely conclusory and did not identify what specific credit information was inaccurate. More importantly, the complaint failed to plausibly allege that a dispute had been submitted through a credit reporting agency and then forwarded to the creditor.
  • The FCRA claim was dismissed without prejudice, leaving open the possibility that the plaintiff could amend the complaint if additional facts can be alleged. At the same time, the broader decision dismissed multiple federal claims and declined to exercise jurisdiction over the remaining state law claims.
