FCRA and FDCPA Claims Follow Alleged Post-Payment Reporting

Credit reporting is not for the faint of heart. There are a lot of places where the process can get confusing and break down. A consumer has filed suit against a collection operation and the original creditor, accusing them of violating the Fair Credit Reporting Act and the Fair Debt Collection Practices Act after allegedly reporting a balance on a debt that had already been settled and then quickly verifying that balance during a dispute.The case, which has been removed to federal court, centers on what many in the industry will recognize as a high-risk moment: the intersection of settlement execution, furnishing timing, and dispute handling.

The background: The plaintiff had a disputed wireless account balance that was ultimately assigned to a collection operation, according to the complaint. After prior credit reporting activity had ceased, the plaintiff entered into a settlement agreement in December 2025 with the collector to resolve the account for roughly half of the original balance through a structured payment plan.

  • The plaintiff alleges that all payments were made on time and that the final payment in late February 2026 satisfied the account in full. At that point, the expectation was that the matter was closed.
  • Instead, shortly after the final payment, the defendants allegedly began furnishing the account to a credit reporting agency with an outstanding balance of approximately $1,588.
  • The complaint further alleges that the plaintiff disputed the balance with the credit bureau in early March and included proof of payment. The dispute was transmitted to the furnisher, which then verified the balance as accurate the following day.

The claims: The lawsuit alleges violations of the FCRA tied to the furnisher’s post-dispute obligations, specifically the duty to conduct a reasonable investigation, review relevant information, and correct inaccurate reporting. The plaintiff claims the defendants “falsely verified” the balance and failed to modify or delete inaccurate information after receiving notice of the dispute.

  • On the FDCPA side, the claims focus on the characterization and communication of the debt. The plaintiff alleges that reporting a balance after full satisfaction and verifying that balance constitutes a “false representation of the character, amount, or legal status of the debt.”
  • The complaint also highlights operational conduct during follow-up communications, alleging that representatives acknowledged the issue but failed to follow through and, in two instances, terminated calls when the plaintiff attempted to resolve the matter.
