Appeals Court Backs Dismissal After ‘Egregious’ Filing Errors and Rule Violations

The Court of Appeals for the Eleventh Circuit has affirmed the dismissal of a Fair Credit Reporting Act lawsuit against two credit reporting agencies, concluding that the plaintiff’s repeated procedural violations and reliance on nonexistent legal authority justified the lower court’s decision to dismiss the case with prejudice.

The background: The plaintiff, proceeding without legal representation, filed suit in federal court in Florida alleging that the defendant credit reporting agencies violated the FCRA by removing certain information from his credit report. Early in the case, the court flagged issues with the complaint, describing it as a “shotgun pleading” and ordering the plaintiff to amend it to comply with procedural rules.

  • What followed was a steady stream of filings that raised concerns. The plaintiff filed numerous motions, including for summary judgment, sanctions, and judicial notice, many of which were denied for failing to comply with court rules. More notably, the defendants pointed out that several of the legal authorities cited by the plaintiff did not exist. The plaintiff later admitted that some of these citations were generated using artificial intelligence and acknowledged that certain cases he referenced were not real.
  • Despite multiple warnings from the court and two separate show-cause hearings, the plaintiff continued to submit filings that misquoted cases, misrepresented legal holdings, and failed to follow procedural requirements. The magistrate judge described the conduct as “some of the most egregious things” she had seen from a pro se litigant and ultimately recommended dismissal with prejudice, finding that no lesser sanction would address the behavior.

The ruling: On appeal, the Eleventh Circuit focused less on the underlying FCRA allegations and more on the procedural posture of the case. The court emphasized that dismissal with prejudice is an extreme sanction, appropriate only where there is a “clear pattern of delay or willful contempt” and where lesser sanctions would be ineffective.

  • Here, the appellate court found that standard was met. It pointed to the plaintiff’s “repeated ignorance of court orders,” continued citation to nonexistent cases, and misstatements of legal authority “in countless vexatious filings” as evidence of willful misconduct.
  • The court also noted a critical procedural misstep on appeal: the plaintiff failed to properly challenge the dismissal in his opening brief, effectively abandoning that argument.
  • As a result, the Eleventh Circuit concluded that the district court acted within its discretion in dismissing the case and affirmed the decision in full.
