Judge Rejects Claims Against Credit Bureaus and Collector in Dispute Over Vehicle Lease Charges

A District Court judge in New Jersey has dismissed Fair Credit Reporting Act and Fair Debt Collection Practices Act claims stemming from a disputed vehicle lease balance, ruling that the plaintiff’s allegations centered on a legal disagreement over the debt itself rather than inaccurate credit reporting or unlawful collection activity. The ruling involved claims against multiple defendants, including two credit reporting agencies and a debt collector, after the plaintiff disputed charges assessed following the early return of a leased vehicle and challenged a subsequent text message sent during collection efforts. The court ultimately granted the motions filed by the defendants and denied the plaintiff leave to amend the complaint again.

The background: The plaintiff leased a vehicle and returned it early, triggering obligations under the lease agreement that included a final payment and other charges. Before receiving the final bill, the plaintiff calculated what she believed she owed and electronically paid approximately $2,300 when returning the vehicle.

  • According to the ruling, the finance company later refunded part of that payment and billed the plaintiff for an additional balance exceeding $2,400, which included unpaid lease payments, excess mileage charges, a turn-in fee, official fees, and taxes. The balance was then reported to the credit bureaus.
  • The plaintiff alleged the credit reporting agencies violated the FCRA by failing to conduct a reasonable investigation into what she claimed was inaccurate or misleading information.
  • She also alleged the debt collector violated the FDCPA by sending a misleading collection letter and communicating with her despite her representation by counsel.

The ruling: Judge William J. Martini of the District Court for the District of New Jersey concluded that the plaintiff’s FCRA claims failed because the dispute centered on the legal validity of the balance owed under the lease, not on factual inaccuracies in the reporting itself. The judge noted that credit reporting agencies are not required to resolve legal disputes between consumers and lenders as part of their reinvestigation obligations.

  • The FDCPA claims failed for similar reasons. The judge held that the plaintiff was effectively disputing the enforceability and validity of the debt itself, which does not automatically create an FDCPA violation. The judge cited prior rulings emphasizing that the FDCPA is intended to regulate collection practices, not adjudicate underlying contract disputes.
  • Judge Martini was also unpersuaded by allegations surrounding the text message sent by the debt collector. The opinion stated that it “strains credulity” to suggest the text referenced the plaintiff’s account with the finance company because the account numbers did not match. The judge also noted there was no indication the collector knew the plaintiff was represented by counsel when the text was sent.
