New Jersey Court Dismisses FCRA and FDCPA Claims Tied to Account Transfer

A federal judge in New Jersey has dismissed a pro se lawsuit accusing a debt buyer and loan servicer of violating the Fair Credit Reporting Act, Fair Debt Collection Practices Act, and New Jersey Consumer Fraud Act over the reporting and transfer of an account.

The background: The lawsuit centered on a line of credit originally issued by Tally Technologies in 2022. According to the complaint, Tally ceased operations in 2024 and transferred servicing of open accounts to another company, which later transferred the account to a debt buyer. The plaintiff alleged the transfer process created multiple account identifiers, inconsistent reporting regarding the original creditor, and inaccurate tradelines furnished to the credit reporting agencies.

  • The plaintiff also claimed the defendants failed to properly investigate disputes, misrepresented the ownership and status of the account, and continued collection communications after a cease-and-desist notice had allegedly been sent.
  • One of the more unusual allegations involved the plaintiff’s contention that the debt buyer improperly accessed the plaintiff’s credit report through a soft inquiry before ownership of the account had officially transferred.
  • In addition, the plaintiff argued that the changing references to Tally Technologies, Cross River Bank, the servicer, and the debt buyer created confusion over who actually owned the account.
  • An amended complaint later filed after the dismissal also expanded on allegations that the account was reported as closed and later reopened after litigation began, and that different creditor names appeared across various credit reports and communications.

The ruling: Judge Jamel K. Semper of the District Court for the District of New Jersey concluded that the original complaint relied too heavily on conclusory allegations and failed to plead enough specific facts to support viable FCRA or FDCPA claims.

  • On the FCRA claims, the judge noted that although the plaintiff alleged inaccurate reporting and unreasonable investigations, the complaint failed to identify precisely what information was inaccurate or how the investigations were deficient.
  • The judge also found that the plaintiff failed to plausibly allege violations of specific FDCPA provisions. While the debt buyer may have qualified as a debt collector, Judge Semper said the complaint did not tie the alleged conduct to any actionable false representation, unfair practice, or validation failure under the statute. The opinion also pointed out that documents attached by the plaintiff appeared to show that validation notices had in fact been provided.
  • The judge dismissed the NJCFA claim as well, concluding the allegations did not fit the type of consumer transaction traditionally covered by the statute.
  • The plaintiff’s amended filing adds more detailed allegations regarding disputed tradelines, account reopening activity, alleged inconsistencies in creditor identity reporting, cease-and-desist communications, and the timing of the debt buyer’s credit inquiry.
