Wisconsin Appeals Court Affirms Dismissal of FDCPA, State Law Claims Over Attorney Involvement and Fee Demands

A Wisconsin appellate court has affirmed the dismissal of a consumer’s claims under the Fair Debt Collection Practices Act and the Wisconsin Consumer Act, rejecting arguments that a collection law firm’s attorney was not meaningfully involved in preparing collection communications and that demands for unadjudicated legal fees were misleading.

The background: A collection law firm filed a small claims complaint on behalf of a medical provider to recover an outstanding balance of $1,304.86 on a medical debt.

  • After being served, the consumer contacted the firm and was told he owed more than the amount stated in the complaint because legal fees, including filing and service charges, had been added. When the consumer objected that those fees had not yet been awarded by a court, a firm employee told him the firm would “get” the fees eventually.
  • The defendant was also told that paying the $1,304.86 would be treated as a partial payment, but that $1,400 would satisfy the debt in full.
  • He paid $1,304.86, stating he did not know whether he could be compelled to pay more.
  • The case was dismissed with prejudice shortly after.
  • The defendant then filed his own action against the medical provider and the law firm, asserting four claims in total. Two were based on the theory that the attorney of record was not “meaningfully involved” in preparing the demand letter and complaint, given his high caseload, which the defendant alleged ran to thousands of active matters. The other two claims were based on the firm’s alleged demand for legal fees that had not yet been awarded by a court.

The ruling: The Court of Appeals affirmed the dismissal of all four claims. On the meaningful involvement claims, the court declined to recognize the doctrine under the FDCPA, noting that the plain language of the statute does not require an attorney’s meaningful involvement and that developing new legal standards is the function of the Wisconsin Supreme Court, not an intermediate appellate court.

  • The court also rejected the parallel state law claim, citing its own recent published decision that had already declined to read a meaningful involvement requirement into the Wisconsin Consumer Act.
  • On the claims arising from the demand for unadjudicated fees, the court found the defendant had not alleged facts that would plausibly mislead an unsophisticated consumer. Unlike cases where debt collectors buried fees inside a lump sum balance without explanation, the firm here clearly communicated that any amount beyond the $1,304.86 complaint figure represented legal fees.
  • The court also distinguished a case the defendant relied on, noting that in that case the collector demanded costs after the underlying suit had already been dismissed without a judgment, meaning it had no legal right to recover them. Here, the medical provider still had a legal right to seek costs, and under Wisconsin law, cost awards to a prevailing party are automatic.
