Senate Banking Dems Move to Lock In a CFPB Funding Floor

All 11 Democrats on the Senate Banking Committee yesterday announced they were introducing legislation that would set a mandatory funding floor for the Consumer Financial Protection Bureau, a bid to insulate the agency’s budget from the cuts and withholding that have defined its past year.

The measure, led by Ranking Member Sen. Elizabeth Warren [D-Mass.], would require the Federal Reserve to transfer to the CFPB at least 12% of the Fed’s total operating expenses each fiscal year, capped at the Dodd-Frank amount “reasonably necessary” to carry out the bureau’s work.

The mechanical shift is the story. Under current law, the CFPB can draw up to 12% of the Fed’s inflation-adjusted 2009 operating expenses, a ceiling. The discussion draft rewrites that provision so the transfer “shall be not less than” 12%, converting the ceiling into a floor and making disbursements compulsory rather than discretionary.

The timing is political. Republicans control the chamber, and Sen. Warren framed the bill as a marker for a future majority, saying Democrats are united in fully funding the bureau “when we take back Congress.” That positions the measure as a signal rather than imminent law.

The backdrop will be familiar to anyone tracking the bureau. A July reconciliation provision cut the CFPB’s available operating budget from 12% toward roughly half that level, and the One Big Beautiful Bill Act reduced the funding transfer cap to about $466.8 million for fiscal 2026. Acting Director Russell Vought has separately sought to deny the bureau funds through a disputed reading of the Fed’s “combined earnings,” a theory now contested in court. The Supreme Court upheld the CFPB’s funding structure in 2024.

The near-term takeaway is less about this bill’s odds and more about the trajectory it underscores. The bureau’s enforcement and rulemaking capacity remains tied to an unsettled funding question, leaving regulated firms to plan around a supervisor whose resources, and appetite, could swing sharply with the next election.

The bill drew endorsements from the National Consumer Law Center, the Consumer Federation of America, Americans for Financial Reform, the Protect Borrowers project, the National Community Reinvestment Coalition, and the Center for Responsible Lending. Backers point to the CFPB’s claim of returning more than $21 billion to consumers as evidence the agency earns its keep.
