Court Trims Pro Se FDCPA Suit to a Single Cease-Communication Count

A District Court judge in Arizona has narrowed a Fair Debt Collection Practices Act lawsuit down to a single cease-communication claim, while warning the plaintiffs that fabricated, apparently AI-generated quotes could draw sanctions if repeated.

The background: The suit grew out of a credit card account that the plaintiff never really contested owing.

  • The plaintiff ran up the balance on a card issued by a lender, with charges for online shopping, auto parts, medical care, and court fees. The plaintiffs never disputed that those purchases were real.
  • The plaintiff argued the debt had been erased through an “accord and satisfaction,” saying he mailed the lender checks for less than the full balance, marked as payment in full, which the lender cashed. He claimed he did this twice.
  • After the account was sold to a debt buyer and later placed with a collection agency, the plaintiff answered each collection attempt with an identically worded settlement letter stating that cashing the enclosed check would satisfy the debt and that he was “unwilling to pay” anything more. Both defendants cashed the checks and kept collecting.
  • The plaintiffs then sued under the FDCPA, arguing the defendants misrepresented and tried to collect a debt that no longer existed, and kept contacting the plaintiff after he refused to pay in writing.

The ruling: Judge Susan M. Brnovich of the District Court for the District of Arizona denied the plaintiffs’ request to revisit an earlier dismissal and pared their remaining claims down to one.

  • The accord-and-satisfaction theory failed because settling a debt by partial-payment check only works when the amount owed is genuinely uncertain and in dispute. Here the plaintiffs listed the exact charges, making the balance a fixed, calculable sum, and never contested that the lender was owed all of it. That defect sank eight of the nine FDCPA counts, dismissed with prejudice as futile to replead.
  • In seeking reconsideration, the plaintiffs quoted two passages supposedly from their earlier complaint that did not exist. Comparing the fabricated quotes to the real paragraphs, the judge concluded, “This is ostensibly the result of generative AI.” She pointed to the rapid turnaround and phantom citations as classic signs of AI use, noted the plaintiffs had signed a verification swearing everything was true under penalty of perjury, and warned that “Future misuses of AI will warrant sanctions.”
  • The one surviving count is the cease-communication claim under Section 1692c(c). Judge Brnovich read that bar broadly to cover any message about the debt, not just demands for payment. The debt buyer emailed again after the written refusal, and the agency sent a note thanking the plaintiff for his payment and reciting his balance. That the agency’s email carried the standard “attempt to collect a debt” disclosure undercut its argument that the message had nothing to do with collection.
  • The judge also struck newly added negligence, FCRA, and breach-of-contract counts as beyond the scope of the amendment she had allowed, and dismissed the second plaintiff for lack of standing, since none of the communications were directed to her.
