Warren Report Claims CFPB Rollbacks Have Cost Consumers $26.5 Billion as Vought Faces Senate Grilling

Democrats on the Senate Banking Committee released a report last week claiming the Trump Administration’s overhaul of the Consumer Financial Protection Bureau has cost American consumers up to $26.5 billion since early 2025, timing the release to coincide with Acting Director Russell Vought’s oversight hearing before the committee.

The report, prepared by the committee’s Minority Staff and championed by Ranking Member Sen. Elizabeth Warren [D-Mass.], builds on a February analysis that pegged 2025 consumer costs at $19 billion. The new figure adds $7.5 billion for the first half of 2026, attributed entirely to two rescinded rules. The bulk of the total, $15 billion, stems from the Bureau’s April 2025 agreement in federal court to vacate its rule capping most credit card late fees at $8, a regulation the agency had estimated would save consumers roughly $10 billion annually. Another $7.5 billion is tied to the repeal of the overdraft fee rule, which would have limited charges at large banks to $5 per transaction. The remaining $4 billion reflects dropped enforcement actions and abandoned settlements, some of which would have delivered payments directly to consumers.

The hearing itself covered familiar territory. Republicans defended the restructuring as a necessary correction to an agency they view as having exceeded its mandate, while Democrats pressed Vought on staffing cuts, dismissed enforcement cases, and an allegation that the Bureau removed 15 years of consumer complaint data from its website. Ahead of the hearing, Warren sent Vought a letter cataloging congressional oversight requests she says the agency has ignored, and joined Sen. Jack Reed [D-R.I.] in a second letter warning that planned regional office relocations could harm servicemembers.

The $26.5 billion figure drew swift pushback. The Cato Institute called the methodology “hopelessly oversimplified,” arguing the analysis counts foregone fee savings as consumer costs without accounting for how banks would respond to price caps, such as tightening credit access or raising fees elsewhere. Cato also noted that courts have rejected several of the Bureau’s legal theories, including the late fee rule itself.

The backdrop for all of this is succession. The Senate is weighing President Trump’s nomination of Brian Johnson, a former CFPB deputy director now at Capital One, to lead the agency permanently. For the accounts receivable management industry, the fight over these numbers is a preview of the oversight posture a confirmed director will inherit, and how durable the current enforcement pullback proves to be.
