New Standard Asks One Question of AI: Is It Actually Working for the Consumer?

Consumer Reports has published what it calls the first independent, consumer-centered AI standard for financial services, a framework that offers an early look at the expectations regulators, courts, and consumers may soon bring to AI deployed across the financial ecosystem, including in credit and collections.

The Consumer Finance AI Standard builds on the organization’s April research paper, “AI in Consumer Finance: A Landscape Analysis of Market Forces, Evaluation Frameworks, and Regulatory Gaps.” It organizes its expectations into nine principles, from security and data minimization to a “duty of loyalty” requiring AI products to advance the consumer’s financial interests over the company’s, and a “duty of vigor” obligating AI to proactively surface consumer rights under laws like the FCRA and ECOA without being asked.

Why it matters: The standard arrives with survey data that should catch the attention of anyone watching the regulatory horizon. In a fall 2025 Consumer Reports survey, 57% of respondents said current law does not adequately protect them from AI risks in financial services. Fully 92% want to know when AI is involved in financial decision-making, 77% want the ability to opt out of AI-driven decisions on major financial matters, and fewer than 10% completely trust financial companies to use AI responsibly. Those numbers describe a public primed to support new oversight.

The framework’s most distinctive move is its treatment of sycophancy, the tendency of AI models to tell users what they want to hear. Consumer Reports classifies that behavior not as a technical glitch but as an “honesty failure,” on par with inaccuracy or manipulation.

“A key characteristic of these models that no one has solved for yet is engagement,” said Delicia Hand, senior director of the digital marketplace at Consumer Reports and a former Consumer Financial Protection Bureau official. She warned against deploying “models that we didn’t fully understand.”

Between the lines: For the ARM industry, the standard’s provisions on escalation and redress deserve close reading. Hand raised concerns about a new kind of “doom loop,” in which a sophisticated AI decides it can resolve a consumer’s complaint itself and declines to route the caller to a human. The framework calls for tiered escalation, human fallbacks for critical functions, and explicit consumer confirmation before any AI-initiated transaction, requirements that map directly onto the chatbots and agent-assist tools already common in collections.

The standard is voluntary. But Consumer Reports notes that AI creates no exemptions from existing civil rights, fair lending, or UDAAP laws, and voluntary frameworks have a history of hardening into examiner expectations. Firms deploying AI in consumer-facing roles may want to measure themselves against this one before someone else does.
