Judge Denies Motions to Dismiss FDCPA, Bankruptcy Stay Claims

A District Court judge in Pennsylvania has denied motions to dismiss a consumer’s lawsuit accusing a university and its in-house attorney of violating the Fair Debt Collection Practices Act and other consumer protection statutes while trying to collect an unpaid tuition balance.

The background: The dispute grew out of the plaintiff’s effort to finish a master’s degree she had nearly completed before the pandemic derailed her finances.

  • The plaintiff enrolled in a graduate program in 2018 under a deferred payment arrangement requiring roughly $7,590 each academic quarter. She paid on time through the 2018-2019 year and finished most of the 45 required credits, leaving only three courses.
  • After she missed a tuition payment in early 2020, the university began adding escalating late fees and refused to re-enroll her until the balance was cleared. When the pandemic forced her to pause her studies to care for family members, the university added more fees and locked her out of the student portal, cutting off access to her transcripts, payment history, and program communications.
  • Around the same time, the university received roughly $31 million in federal emergency aid earmarked for students with unmet need, but the plaintiff argued she was never told the money existed or that she might qualify, in part because she could not reach her portal.
  • In early 2021, the plaintiff filed for Chapter 13 bankruptcy. She did not list the university as a creditor, yet the university kept assessing late fees while the automatic stay was in effect.
  • Late in 2023, the university, acting through its in-house attorney, filed a collection action in state court seeking more than $21,000 in tuition, fees, and costs. The plaintiff notified the attorney of her bankruptcy, and he placed the state case in deferred status.
  • The plaintiff says she learned only in 2025, during a call about re-enrolling, that the program she had been trying to finish had quietly been discontinued years earlier. Representing herself, she filed a fifteen-count complaint in federal court, and the defendants moved to dismiss several claims and to send the case to state court.

The ruling: Judge Wendy Beetlestone of the District Court for the Eastern District of Pennsylvania denied the motions across the board, finding the plaintiff’s claims rested on far more than the single collection suit the defendants had zeroed in on.

  • On timeliness, the judge held the FDCPA and related state-law claims were not tied solely to the 2023 lawsuit. Because the plaintiff alleged that the withholding of her transcripts and portal access to pressure repayment was ongoing, those claims fell within the statute’s one-year window.
  • Judge Beetlestone found the plaintiff had adequately alleged a bankruptcy stay violation. Withholding a student’s records to coerce payment of a pre-bankruptcy debt, the judge wrote, can be both a stay violation and a compensable harm, a tactic several states have already moved to ban.
  • On the Equal Credit Opportunity Act claim, the judge agreed with the university on one narrow point: declaring an account in default is not, by itself, an “adverse action” that triggers the statute’s notice requirements. But because the university never addressed the plaintiff’s separate allegations about refusing to extend credit and accelerating the balance, it waived any challenge, and the claim survived. The judge described the university’s briefing as “a perplexing discussion” of the plaintiff’s re-enrollment attempts.
  • The judge also declined to dismiss the request for a declaratory judgment, faulting the defendants for citing no authority. Their position, she said, ran “from soup to nuts” without support and failed the district’s rules on motion practice.
  • Finally, the judge refused to move the surviving claims to state court, noting that remand is available only for cases removed from state court, not those filed directly in federal court.
