Judge Sends ID Theft FCRA Suit to Arbitration, Calls Thief-Followed-Her Theory ‘Manifestly Unreasonable’

  • A flight attendant said an identity thief opened a retail card in her name. Then discovery matched more than two dozen charges, at Toronto duty-free shops and merchants near JFK, to the exact days Customs records placed her in those cities. Her explanation for that coincidence did not land well with a federal judge in New York, who had a lot to say about mailing presumptions, police reports, and whether a debt buyer’s earlier collection suit waived its right to arbitrate.

Judge Finds Consumer’s Confusion Over ‘Email Alerts’ Was Feigned, Enters Judgment for Debt Buyer

  • The consumer asked for her statements by email, paid for years, then told a Florida judge she was not sure what an email actually is. The judge was not persuaded. But the more useful part of this ruling for debt buyers is how the court handled a witness who never worked for the original creditor yet testified about its mailing practices, and why a much-cited Florida appellate decision did not stand in the way.

Judge Grants Judgment on the Pleadings in 325-Page Student Loan Complaint

  • A 325-page complaint. Twenty-one fraud theories. “181 bluffs,” “1,035 blind spots,” and a “silence scheme,” all built around a 1995 loan consolidation the plaintiff insists never happened. A federal judge in North Carolina found a much simpler story: a bankruptcy court already decided this question more than 20 years ago. See how collateral estoppel and the statute of limitations ended a case the judge said had been argued “ad nauseam.”

Consumers Add Recurring Payments Faster Than Overall Spending for Second Straight Year

  • Subscription spending grew 7.7% in July, well ahead of overall spending, and Gen Z’s recurring payments are growing at four times last year’s rate, according to Bank of America’s internal payments data.
