The Consumer Financial Protection Bureau has issued an Advisory Opinion that clarifies the circumstances under which collectors can charge additional fees, such as convenience fees, to consumers. The opinion also reminds everyone that just because the FDCPA or a state law doesn’t prohibit the assessing of a fee, that is not a green light to do so. At the same time, anti-CFPB sentiment is growing, with trade groups launching ad campaigns outlining how the Bureau is overstepping its authority.
