Federal courts have been attacking whether plaintiffs in Fair Debt Collection Practices Act cases have standing to sue for more than a year. And while cases that are dismissed for lack of standing may seem like wins for the industry, that is not necessarily always the case. In many instances, the plaintiffs instead refile their lawsuits in state court, which creates an entirely different set of headaches.

Acknowledging that sometimes the situation is unavoidable — such as when a judge says so — a panel of legal experts will discuss why arguing cases on the merits is better for the industry in the long term than winning cases on standing.
