SCOTUS RULES IN FAVOR OF ALLOWING COLLECTORS TO USE STATE AG LETTERHEAD WHEN COLLECTING ON BEHALF OF STATES

  • The Supreme Court of the United States unanimously ruled yesterday that lawyers hired by the attorney general of Ohio to collect debts on behalf of the state can use the AG’s letterhead when communicating with consumers. The case had a number of consumer protection advocates, including the Consumer Financial Protection Bureau, weigh in against allowing use of the letterheads, while states lined up behind Ohio to argue why the practice is important. Justice Ginsburg delivered the opinion on behalf of the Court.

SENATE COMMITTEE SCHEDULES HEARING TO DEBATE EFFECTIVENESS OF TCPA

  • The Senate Commerce Committee will hold a hearing tomorrow to debate the efficacy of the Telephone Consumer Protection Act, which is celebrating its 25th anniversary this year. While nobody from the Federal Communications Commission is on the list of witnesses, Greg Zoeller, the attorney general of Indiana, and Margot Saunders from the National Consumer Law Center will be on the panel to represent the voice of consumer protection. Monica Desai, a partner at the law firm of Squire Patton Boggs, and Richard Lovich, a partner at the law firm of Stephenson, Acquisto and Coleman who is testifying on behalf of the American Association of Healthcare Administrative Management, will represent the industry.

LIBRARY WORKING ON RECOUPING $7 MILLION IN UNPAID FINES

  • The San Jose (Calif.) public library system is owed nearly $7 million in unpaid fines and fees and is grappling with how best to handle the problem. The library is proposing an “amnesty” month where individuals with overdue items can return them without question and have the overdue fees waived. Individuals may also get to “read” their way out of debt by joining summer reading programs or volunteering at a local library.
