MINNESOTA AG SUES COMPANY FOR ALLEGEDLY TRYING TO COLLECT ON FAKE PAYDAY LOANS
- The attorney general of Minnesota is suing a Jamaican company for allegedly attempting to collect on fake debts. The company, Global Gateway Solutions, also did business as First Recovery Associates, Northwest Recovery Associates and National Recovery Associates. The collectors would allegedly contact individuals and demand payments for loans that never existed. The number of individuals who were scammed and the total amount the collectors managed to rack up was not made available.
APPEALS COURT RULES GARNISHMENT IS NOT A ‘LEGAL ACTION’ AGAINST ‘A CONSUMER’
- The U.S. Court of Appeals for the Seventh Circuit has ruled that a wage garnishment action taken by a collector is not a “legal action” taken against a “consumer” and is therefore not a violation of the Fair Debt Collection Practices Act. The collector had filed the wage garnishment actions in the district that was closest to the individuals’ employers and not closest to where the individuals resided. A district court had dismissed the actions, which was appealed to the Seventh Circuit.
ACA FILES COMMENT OPPOSING PROPOSED BAN ON ARBITRATION CLAUSES
- ACA International is one of many organizations that have filed a comment opposing the Consumer Financial Protection Bureau’s proposed rule that would essentially ban mandatory arbitration clauses in consumer lending contracts. The CFPB has failed to demonstrate that a problem actually exists, ACA argued in its comment, and that the ban would not comply with “express conditions imposed by Congress in the Dodd’Frank Act.”
ARKANSAS CITY, COUNTY SUED FOR JAILING PEOPLE OVER UNPAID COURT FINES
- The city of Sherwood, Arkansas and Pulaski County, Arkansas are being sued for their practice of imprisoning individuals who write bad checks and are unable to pay the associated fines. The lawsuit alleges that the court should determine whether the individuals have the ability to repay the fines before putting them in jail. The division responsible for enforcing repayment of bad checks issues more than 35,000 warrants a year, the suit claims.
