SUPREME COURT DENIES TO HEAR ARGUMENTS IN FDCPA LETTER CASE
- The Supreme Court yesterday denied a request windows 10 home key to hear arguments in the case of Jones v. Dufek, which would have addressed differing decisions at the Circuit Court level, alleging that sending a collection notice that included the letterhead of an attorney and attorney’s signatures amounted to a precursor of a legal action. The plaintiff alleged that eight different Circuit Court are split on the issue of whether a heightened sense of urgency is created when a collection letter is sent on attorney letterhead. The attorney in this case, David Dufek, said he was acting the capacity of a debt collector and was within his rights to use his firm’s letterhead.
ACA WHITEPAPER PUTS CFPB COMPLAINTS INTO CONTEXT
- ACA International has released a whitepaper that contends the number of complaints related to debt collections filed with the Consumer Financial Protection Bureau is “remarkably low,” when put into the proper context. From ACA: the total number of debt collection complaints received by the CFPB represents 0.004% of individuals who had contact with the debt collection industry during 2016. Further, the complaints account forbuy windows 10 home key only .05% of all individuals estimated to have a debt in collection.
