SCOTUS DECISION IN MIDLAND v. JOHNSON RAISES DIFFICULT QUESTIONS TO ANSWER
- As the dust settles and expert begin parsing the words and details, the recent Supreme Court decision in Midland Funding v. Johnson raises some potentially problematic questions. The Supreme Court ruled that companies that file proofs of claim on time-barred debts during an individual’s bankruptcy process are not violating the Fair Debt Collection Practices Act. But the ruling will put an undue strain on the bankruptcy system and possibly open bankruptcy trustees to more malpractice claims for not objecting to time-barred debts.
