DISTRICT JUDGE POKES ANOTHER HOLE IN SPOKEO DEFENSE
- The Spokeo defense that the ARM industry thought would be a shield against frivolous and arbitrary lawsuits had another hole poked in it last week, when a federal judge in Illinois ruled against a collection agency and a law firm’s motion to dismiss a lawsuit brought by a plaintiff who accused the two companies of violating the Fair Debt Collection Practices Act by inferring that the amount owed may be higher than the unpaid balance on the account.
FTC OBTAINS $4 MILLION JUDGMENT AGAINST JOEL TUCKER IN DEBT BUYING CASE
- Through a federal judge, the Federal Trade Commission has obtained a $4 million judgment against Joel Tucker, who was accused of creating and selling fake debt portfolios. Tucker has also been banned from selling debt debt portfolios as a result of the default judgment. Tucker has been a difficult defendant since the FTC filed suit against him back in December.
