ONE CALL ENOUGH TO MEET CONCRETE INJURY IN TCPA CLASS ACTION, JUDGE RULES
- A federal judge has denied a motion to dismiss a lawsuit from a defendant in a class-action Telephone Consumer Protection Act case after the plaintiff received one call on his cell phone. Judge Jorge Alonso from the District Court for the Northern District of Illinois said that receiving one phone call on a cell phone was enough to satisfy the concrete injury requirements of Article III for the case to stand trial.
JUDGE RULES DEFENSE CAN CALL CORDRAY AS WITNESS AS CFPB TRIAL AGAINST WELTMAN KICKS OFF
- Things are about to start getting interesting in the Buckeye State.A jury was selected yesterday at a courthouse in Cleveland to kick off a lawsuit filed by the Bureau of Consumer Financial Protection against Weltman Weinberg & Reis, in the state where former CFPB director Richard Cordray is campaigning for governor. Meanwhile, a judge ruled yesterday that the defense can call Cordray as a witness, even though the CFPB had filed a motion seeking to block him as a witness.
BILLINGTREE ARM SURVEY REVEALS SHIFT IN OPERATIONAL, COMPLIANCE CONCERNS
- The Bureau of Consumer Financial Protection appears to no longer be what is keeping collection agency executives up at night, according to the results of BillingTree’s sixth annual ARM ‘Operations and Technology’ Survey, which was released this morning. Concerns about CFPB regulations were the lowest of all compliance issues, including PCI, NACHA, and E-Sign, according to the survey’s results, which included input from 150 different collection agencies.
HOUSE COULD VOTE THIS MONTH ON DODD-FRANK OVERHAUL: MAJORITY LEADER
- House Majority Leader Rep. Kevin McCarthy [R-Calif.] said the House may vote this month on legislation to rewrite the Dodd-Frank Wall Street Reform and Consumer Protection Act. Published reports are calling the comments “the strongest sign yet” that momentum is picking up to pass a reform bill and overhaul Dodd-Frank, which was enacted following the global financial crisis a decade ago.
