JUDGE DENIES MOTION TO COMPEL ARBITRATION IN FDCPA CASE OVER TAX LANGUAGE

  • A District Court judge in New Jersey has denied a defendant’s motion to compel arbitration and strike class claims after it was sued for violating the Fair Debt Collection Practices Act by sending letters to the plaintiffs that included language regarding the possibility that the forgiveness of a debt may be reported to the Internal Revenue Service, despite the fact that the amounts being collected were below the threshold for doing so.

ADVOCATES DETAIL CHANGES THEY WANT MADE TO PROPOSED RULE

  • Consumer advocates are now starting to detail their concerns with the Consumer Financial Protection Bureau’s proposed debt collection rule and are detailing the changes they would like to see made.

‘BLAMELESS IGNORANCE’ SHOULD APPLY TO FDCPA SOL SUITS, SCOTUS PETITIONER ARGUES

  • Being “blamelessly ignorant” should be enough to delay the start of a statute of limitations clock in a Fair Debt Collection Practices Act case until the individual in question learns an injury has occurred and the clock should not start when the actual violation happened, the petitioner in an upcoming Supreme Court case submitted yesterday.

FCC ANNOUNCES SUMMIT TO DISCUSS CALLER ID AUTHENTICATION DEPLOYMENT

  • The Federal Communications Commission announced yesterday that it will convene an event in July aimed at showcasing the deployment of the SHAKEN/STIR Caller ID authentication framework. The SHAKEN/STIR initiative is considered an important prong in the regulator’s battle to combat the proliferation of illegal robocalls.

CFPB ANNOUNCES PROMOTIONS, NEW HIRES

  • Kathy Kraninger, the Director of the Consumer Financial Protection Bureau, announced a number of promotions and appointments yesterday, including removing the “acting” descriptor from the job titles of the Bureau’s deputy director and chief operating officer.
