FCA PARTICIPANTS HAPPY TO BE BACK IN LIVE EVENT SADDLE

  • Last week, the Florida Collectors Association held its annual conference at a hotel in Sarasota. It was, as far as I can tell, the first live industry event since the coronavirus pandemic hit the United States in mid-March. The FCA offered a full slate of educational and networking opportunities for those who attended the event in person, while also offering an opportunity to participate virtually to those who could not — or would not — make the trip. AccountsRecovery.net asked some of those who were in attendance to share their perspectives about the event.

JUDGE GRANTS MTD IN FDCPA CASE OVER ALLEGED ‘CONTRADICTION’ IN LETTER

  • A District Court judge in New York has granted a defendant’s motion to dismiss after it was sued for allegedly violating the Fair Debt Collection Practices Act because of an alleged contradiction between a statement on the front of a collection letter about obtaining more information about a debt and the validation notice disclosure that was included on the back page.

JUDGE GRANTS MTD ON STATE COLLECTION LAW WHILE ALSO COMMENTING ON CONSENT REVOCATION

  • A District Court judge in Oregon has granted a defendant’s motion to dismiss a claim it violated a state collection law while also ruling that revocation of consent must be made to all parties instead of assuming that if consent is revoked to one party, then all other parties will be notified and also revoke consent.

REPORT ANALYZES IMPACT OF DEBT BUYING LAW ON LAWSUITS IN CALIFORNIA

  • The Center for Responsible Lending — a consumer advocacy group — has released a report that analyzes the impact of a state debt buying law that was enacted in California in 2013 on the number of debt collection lawsuits filed against consumers in the years since the law went into effect, concluding that the law has had a “modest positive impact” on the number of lawsuits filed, but still concluding that the “decks remain stacked” in favor of debt buyers and against consumers.

CROWN ASSET MANAGEMENT CONTINUES ITS COMMITMENT TO ATLANTA’S FRONTLINE WORKERS
