Judge Sends FDCPA Case Back to State Court, Awards Fees Over Improper Removal

A District Court judge in Wisconsin has delivered a pointed reminder that removing an Fair Debt Collection Practices Act case to federal court can backfire when standing is not clearly established by not only granting a plaintiff’s motion to remand her case back to state court, but also ordering the defendant to pay attorneys’ fees and costs, finding that the removal lacked an objectively reasonable basis.

The background: The plaintiff alleged that she received a collection letter that identified a creditor and account information she did not recognize, which left her confused and misled. She claimed the letter contained false, deceptive, or misleading representations in violation of the FDCPA, along with claims under Wisconsin law.

  • Importantly, the complaint did not allege that the plaintiff paid money she did not owe, that her credit was affected, or that she took or failed to take any action because of the letter.
  • Instead, the alleged harm centered on confusion and uncertainty caused by the communication.

The ruling: Judge Brett H. Ludwig of the District Court for the Eastern District of Wisconsin emphasized that under Seventh Circuit precedent, confusion alone is not enough to establish an injury-in-fact for purposes of Article III standing.

  • The defendant attempted to argue that the risk of future harm, such as the possibility of double payment, was sufficient to establish standing. The judge rejected that argument, noting that the complaint did not allege any actual risk specific to the plaintiff, only general legal propositions about what could happen in theory.
  • Judge LLudwig also addressed the defendant’s reliance on the plaintiff’s request for injunctive relief, pointing out that the request applied only to the state law claim, not the FDCPA claim that served as the basis for federal jurisdiction.
  • Having found no standing, the judge held that he lacked subject matter jurisdiction and was required to remand the case. He then went a step further, awarding attorneys’ fees and costs, concluding that the defendant “lacked an objectively reasonable basis” for removal given the clear precedent on standing in similar cases.
  • One notable aspect of the decision is the judges rejection of post-removal negotiations as a defense. The defendant had attempted to condition a stipulation to remand on concessions from the plaintiff regarding injury. The judge was not persuaded, stating that such negotiations do not retroactively justify removal and criticizing the attempt to “strong arm” the plaintiff into limiting potential claims.
