When ‘Inaccuracy’ Isn’t So Simple: Court Rejects FCRA Claims Over Fraud Dispute

A District Court judge in Virginia has dismissed Fair Credit Reporting Act claims against a lender, finding that a borrower’s dispute over a vehicle loan tied to an undelivered car raised legal questions that fall outside the scope of what the FCRA is designed to address.The decision centers on a relatively unusual fact pattern. The plaintiff entered into a financing agreement for the purchase of a vehicle that was never delivered, after the lender sent more than $54,000 to what allegedly turned out to be a fraudulent seller. Despite reporting the suspected fraud and never receiving the vehicle, the plaintiff was told he remained responsible for repaying the loan.

The background: The plaintiff worked with a purported dealership to purchase a vehicle remotely and executed loan documents with the defendant to finance the transaction. The lender funded the loan and transmitted the purchase amount to the seller, but the vehicle never arrived. The plaintiff alleged that the account receiving the funds was not actually associated with the dealership and that warning signs of fraud were present in the documentation.

  • After reporting the issue to law enforcement and disputing the account, the plaintiff stopped making payments.
  • The defendant continued to report the account as delinquent to the credit reporting agencies.
  • The plaintiff then submitted multiple disputes through the credit bureaus, each of which was verified by the defendant, leading to the continued reporting of the account.
  • The plaintiff claimed that this conduct violated the FCRA, arguing that the reporting was inaccurate or misleading because he never received the vehicle and therefore should not be obligated on the loan.

The ruling: Judge Roderick C. Young of the District Court for the Eastern District of Virginia dismissed the FCRA claims, focusing on a threshold issue that is becoming increasingly important in these cases. To proceed under the FCRA, a plaintiff must first show that the information being reported is actually inaccurate.

  • Here, the judge found that the dispute was not about a straightforward factual inaccuracy, but instead about a legal disagreement over whether the plaintiff remained obligated to repay the loan despite the alleged fraud. As the court explained, “reported information is actionably ‘inaccurate’ only if that information is objectively and readily verifiable.”
  • Judge Young went on to note that resolving the plaintiff’s position would require “complex fact-gathering and in-depth legal analysis,” including questions about contract interpretation and whether the failure to receive the vehicle excused repayment obligations.
  • That distinction proved decisive. Because the dispute turned on legal theories rather than clear factual errors, the court concluded that it was not the type of inaccuracy the FCRA is meant to address. In the court’s words, these kinds of unresolved legal disputes “render[] [the] claim non-cognizable under the FCRA.”
