FTC FINES COLLECTION AGENCY $72,000 FOR FCRA VIOLATIONS
- The Federal Trade Commission yesterday fined a Texas collection agency, Credit Protection Association, $72,000 for failing to adequately handle consumer disputes under the Fair Credit Reporting Act. The agency was accused of not keeping copies of dispute-related documentation from consumers, relying on the original creditors to investigate disputes while maintaining inconsistent processes for transmitting consumer information, and not maintaining proper audit procedures for how it handled consumer disputes.
CITY LOOKS FOR AGENCY TO HELP COLLECT FEES FOR UNPAID LAWN MOWING
- The city of Canton, Miss., is seeking to hire a collection agency to help recoup fees from mowing the lawns of unkept properties around the city. The unpaid bills represent nearly $300,000 annually, according to the city.
FCC COMMISSIONERS FOLLOW PARTY LINES IN SETTING AUTODIALER CALLING LIMITS
- The two Republican commissioners of the Federal Communications Commission tried to get the agency to adopt more collector-friendly rules for using autodialer technology to contact the mobile phones of consumers with unpaid debts that are guaranteed by the federal government, such as student loans. Commissioner Michael O’Rielly, for example, suggested allowing collectors to make two calls per week until contact is made. Ultimately, the three Democrat commissioners approved a rule of allowing three calls per month. Comments on the proposed rule are due by April 6.
